Force majeure
Force majeure covers extraordinary events beyond the parties’ control that could neither be foreseen nor prevented – such as war, natural disasters or widespread strikes. It can release a party from liability for failing to fulfil an agreement. Many policies exclude losses caused by war and similar events.
Examples
A supplier cannot deliver goods because of a war and is released from liability under the contract’s force majeure clause.
